Terms of Service

NudgeLearn is a parent-facing service. You must be at least 18 years old and the parent or legal guardian of any child you enroll. Children do not create accounts — they interact only via SMS or WhatsApp messages sent to their phone.

By enrolling a child under 13, you provide verifiable parental consent under the Children's Online Privacy Protection Act (COPPA) and authorize us to send educational messages to your child's phone number.

We also offer the Grader, a tool that parents and teachers use to grade a photo of a student's handwritten work. Teachers and schools may use it for students they are authorized to instruct. Terms specific to the Grader are in Section 4.

NudgeLearn delivers daily AI-powered math practice questions to your child via SMS or WhatsApp. The service includes:

• Daily push messages with grade-appropriate math questions
• AI-graded responses with hints and explanations
• Weekly progress reports emailed to the parent
• A parent dashboard to manage enrollment and view progress

We use Anthropic's Claude AI to grade answers and generate hints. Message content is educational; we do not send marketing messages to children.

By enrolling a child and providing their phone number, you consent to receive recurring automated text messages from NudgeLearn on that number, including daily math questions, hints, and session summaries.

• Message frequency: Up to 15 messages per day per enrolled child, delivered at the time you select.
• Message and data rates may apply depending on your carrier plan.
• To stop messages: Reply STOP at any time. Messages will cease immediately. You may re-enroll from the dashboard.
• For help: Reply HELP or email hello@nudgelearn.app.
• WhatsApp:Requires age 13+ with parental attestation. Subject to WhatsApp's Terms of Service in addition to these Terms.

Consent to receive messages is not a condition of purchasing any goods or services.

NudgeLearn also offers the Grader, a tool that uses AI to grade a photo of a student's handwritten work. You upload a photo or PDF of completed work, and we transcribe the problems, grade the answers, and mark the page. It is offered as a free tier and a paid Grader Pro subscription.

• Who may use it. You must be at least 18 years old. You may submit work belonging to your own child or, if you are a teacher or school, to students you are authorized to instruct. By uploading a photo, you represent that you have the authority to submit that student's work for grading and have obtained any parental or school consent required to do so.
• AI grades are a starting point, not a final authority. Grading is performed by AI (Anthropic Claude, with text recognition by Google Cloud Vision) and may be wrong — particularly on hard-to-read handwriting, non-standard solutions, or subjects other than math. You are responsible for reviewing each result before relying on it, and you should not use Grader output as the sole basis for a student's official grade, academic standing, or any other consequential decision.
• Your content. You keep ownership of the photos and work you upload. You grant us a limited license to process, store, and display that content solely to provide the grading service to you and, for teacher accounts, to organize grades into the classes and assignments you create. We handle uploaded student work as described in our Privacy Policy and Data Retention Policy.
• Grader Pro billing. Grader Pro is billed monthly or annually through Stripe and renews automatically until you cancel. You can cancel anytime from your account; cancellation stops future renewals and takes effect at the end of the current billing period, and we do not issue partial refunds for the remaining period. We never store your card number. Billing questions: hello@nudgelearn.app.

These terms cover NudgeLearn tutoring subscriptions. Grader subscriptions are covered in Section 4.

• NudgeLearn is offered as a paid subscription. Current pricing is shown at checkout.
• Subscriptions renew automatically at the end of each billing period unless cancelled.
• You may cancel at any time from the dashboard or by emailing us.
• 7-day money-back guarantee.If you cancel within 7 days of starting a subscription line, we refund what you paid for that line in full and end service immediately. Refunds post to the original card within 5–10 business days. One refund per family per phone number.
• After the 7-day window, cancellation takes effect at the end of the current billing period and no partial refunds are issued for the remaining time.
• We use Stripe for payment processing. We never store your card number. Stripe's terms apply to payment transactions.
• We reserve the right to change pricing with 30 days' advance notice by email.

You agree not to:

• Provide false information when creating an account or enrolling a child
• Enroll a phone number you do not have authority to use
• Attempt to reverse-engineer, scrape, or abuse the service
• Use the service for any unlawful purpose

We may suspend or terminate accounts that violate these Terms without prior notice.

Our Privacy Policy explains what data we collect, how we use it, and your rights under COPPA. By using NudgeLearn, you agree to our Privacy Policy. Key points:

• We collect only the minimum data needed to deliver the service.
• We do not sell data or use it for advertising.
• Parents may review, correct, or delete their child's data at any time from the dashboard or by emailing hello@nudgelearn.app.

All content, software, and materials on NudgeLearn (including question banks, AI prompts, and the dashboard) are owned by NUDGELEARN LLC or its licensors. You may not copy, reproduce, or distribute any part of the service without our written permission.

By submitting feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

NudgeLearn is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will always be accurate. The service is a supplemental educational tool and is not a substitute for formal schooling or professional tutoring.

To the fullest extent permitted by law, NUDGELEARN LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the revised Terms.
