Terms of Service

These Terms of Service ("Terms") govern your use of NudgeLearn, operated by NUDGELEARN LLC, a New Jersey limited liability company ("NudgeLearn", "we", "us", or "our"). By creating an account or using the Grader, you agree to these Terms.

1. Who may use NudgeLearn

You must be at least 18 years old to hold an account with us. NudgeLearn operates one service: the Grader, a tool teachers and parents use to grade student work, whether worksheets, tests or essays, photographed, scanned or uploaded as a file. Teachers and schools may use it for students they are authorized to instruct. Students do not hold accounts and never sign in.

Where a school or district has signed a data processing agreement with us, that agreement governs the student data covered by it, and its terms control over these Terms wherever the two differ. See our Data Processing Addendum.

2. The Grader

The Graderuses AI to grade a photo of a student's handwritten work. You upload a photo or PDF of completed work, and we transcribe the problems, grade the answers, and mark the page. It is offered as a free tier and a paid Grader Pro subscription.

  • Who may use it. You must be at least 18 years old. You may submit work belonging to your own child or, if you are a teacher or school, to students you are authorized to instruct. By uploading a photo, you represent that you have the authority to submit that student's work for grading and have obtained any parental or school consent required to do so.
  • AI grades are a starting point, not a final authority. Grading is performed by AI (Anthropic Claude, with text recognition by Google Cloud Vision) and may be wrong, particularly on hard-to-read handwriting, non-standard solutions, and open-ended work where reasonable graders disagree. You are responsible for reviewing each result before relying on it, and you should not use Grader output as the sole basis for a student's official grade, academic standing, or any other consequential decision.
  • Your content. You keep ownership of the photos and work you upload. You grant us a limited license to process, store, and display that content solely to provide the grading service to you and, for teacher accounts, to organize grades into the classes and assignments you create. We handle uploaded student work as described in our Privacy Policy and Data Retention Policy.
  • Grader Pro billing. Grader Pro is billed monthly or annually through Stripe and renews automatically until you cancel. You can cancel anytime from your account; cancellation stops future renewals and takes effect at the end of the current billing period, and we do not issue partial refunds for the remaining period. 3. Acceptable use

You agree not to:

  • Provide false information when creating an account
  • Upload work belonging to a student you are not authorized to instruct or parent
  • Attempt to reverse-engineer, scrape, or abuse the service
  • Use the service for any unlawful purpose

We may suspend or terminate accounts that violate these Terms without prior notice.

4. Privacy and student data

Our Privacy Policy explains what data we collect, how we use it, and your rights. By using NudgeLearn, you agree to it. Key points:

  • We collect only the minimum data needed to grade the work.
  • We do not sell data or use it for advertising.
  • A teacher or parent may review, correct, export or delete a student's data at any time in the app or by emailing hello@nudgelearn.app. Where a school is the account holder, requests about a student go through the school.

5. Intellectual property

All content, software, and materials on NudgeLearn (including question banks, AI prompts, and the dashboard) are owned by NUDGELEARN LLC or its licensors. You may not copy, reproduce, or distribute any part of the service without our written permission.

By submitting feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

6. Disclaimers

NudgeLearn is provided "as is" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI-generated content will always be accurate. The service is a supplemental educational tool and is not a substitute for formal schooling or professional tutoring.

7. Limitation of liability

To the fullest extent permitted by law, NUDGELEARN LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Governing law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles. Any disputes shall be resolved in the state or federal courts located in New Jersey.

9. Changes to these Terms

We may update these Terms from time to time. We will notify you by email at least 14 days before material changes take effect. Continued use after that date constitutes acceptance of the revised Terms.
